Projectos PPP reclassificados como Administração Pública

O Instituto Nacional de Estatística (INE) anunciou mais uma revisão do valor do défice da AP e da dívida pública de 2010, devido  à inclusão de três projectos contratados em regime de PPP no perímetro de consolidação da Administração Pública.  Assim, o défice de 2010 passou para 9,1% (contra 8,6% indicado anteriormente) e a a dívida pública passou de 92,4% para 93% do PIB.  

Segundo o Público, o que aconteceu foi que, em três casos específicos, o INE e o Eurostat deixaram de aceitar a lógica de contabilização que é usada nas PPP, ou seja, que o investimento inicial na construção das infra-estruturas não seja registado no défice nem na dívida no ano de construção.  

Os três projectos em causa são as concessões Scut do Norte Litoral (concessão Euroscut/Ferrovial, com investimento de 318 milhões de euros) e da Costa de Prata (concessão Ascendi/Mota Engil, com investimento de 320 milhões), em que entretanto foram introduzidas portagens e onde se registam elevados volumes de tráfego. Por outro lado, está também a concessão do Túnel do Marão, uma auto-estrada com cerca de 30 km de extensão, situada entre Amarante e Vila Real e que inclui um túnel de 5,6 km, que será o maior túnel rodoviário nacional. Esta obra, orçada em cerca de 350 milhões de euros e concessionada à Somague, apenas deverá estar concluída entre o terceiro e o quarto trimestre de 2012.


Se se mantivesse o mesmo perímetro das administrações públicas de 2009, o défice seria o inicialmente estimado, 6,8 por cento, segundo o Ministério das Finanças.  Isto significa que a desorçamentação que consiste em encargos extra-orçamentais não cambimentados, acrescentou 2,3 pontos percentuais aos défice em 2010.

Renegotiations of PPPs are pervasive

"Renegotiations of PPPs are pervasive ( e não só em Portugal).
We argue that they can be used by incumbents (governments) to elude normal budgetary constraints and anticipate infrastructure spending. We show that renegotiations foster lowballing in ex ante auctions and both include additional compensations for the works originally contracted and add works not contemplated in the original contract.
Nevertheless, spending anticipation is not inherent to PPPs, but the consequence of defective accounting standards. We show that if PPP investments are included as investments in the public budget spending caps prevent anticipation.

As renegociações, em regime ajuste directo Concedente-concessionário, permitem todo o tipo de abusos que se podem classificar como "captura do concedente", em beneficio de concurso publico nem tranparência, nem vistos do Tribunal de Contas. 
As negociações de contratos de concessão e PPP deveriam ser estritamente limitadas e sujeitas às mesmas regras de transparência do que a adjudicação original. O abuso dos contratos de PPP, em termos de montantes excessivos e de renegociações descontroladas, é uma dos principais causas da crise do sobre-endividamento de Portugal

The Asian Development Bank Infrastructure Technical Assistance (ITA) is assisting Timor–Leste’s Ministry of Infrastructure (MoI) to prepare, procure and manage consulting services, goods and works required for the annual capital development program.  This is a currently running ADB TA Project.
An international Legal Specialist will be required to work in the Ministry of Infrastructure (MoI) in Dili, Timor-Leste. The specialist will be engaged for 6 months. 

Applicant Requirements:
  1. 10 years legal experience linked to the preparation of decree laws in engineering, infrastructure or related disciplines and have worked extensively in developing countries, preferably Timor-Leste or the pacific region
  2. The specialist must be fluent in spoken and written English and Portugese, since the specialist will be required to prepare high-quality Portugese and English legal language documentation and be able to read and understand the many Portugese language documents in use within the MoI.
  3. Knowledge of Bahasa Indonesian would be an advantage as many of the documents prepared will have to be translated into Bahasa. 

Description of Duties:
The major tasks of the Legal Specialist include but are not limited to the following:
  1. prepare a draft Decree Law for Geometric Design Standards for  Roads, for use in Timor Leste;
  2. prepare the draft decree law in the Portuguese language ready for presentation to the Counsel of Ministers and other related documents including justifying notes, according to the legislative procedures of Timor-Leste;
  3. ensure that the content of draft decree law is consistent with the design standards for roads as prepared by the Road Design Engineer (RDE) engaged for this task;
  4. participate in a seminar, arranged by the RDE, for MoI personnel after the circulation of the draft final report for comments and ensure these are incorporated in the draft decree law;
  5. prepare a draft Decree Law for Bridge Standards  for use in Timor Leste;
  6. prepare the draft decree law in the Portuguese language ready for presentation to the Counsel of Ministers and other related documents including justifying notes, according to the legislative procedures of Timor-Leste;
  7. ensure that the content of draft decree law is consistent with the bridge standards prepared by the Bridge Design Engineer (BDE)
  8. participate in a seminar, arranged by the BDE, for MoI personnel after the circulation of the draft final report for comments and ensure these are incorporated in the draft decree law;

Expected outputs would include:
  1. Final draft decree law for road geometric design standards by December 2011
  2. At least 3 MOI Staffs are trained on legal requirements of the decree law

Crédito e garantias a concessionárias de PPP absorvem capacidade de crédito

Bancos nacionais garantem crédito de 2,7 mil milhões para PPP

A maior fatia de financiamento vai para as concessões rodoviárias com 2,3 mil milhões de euros.
Os principais bancos nacionais garantiram um volume de financiamento de 2,7 mil milhões de euros para os investimentos em Parcerias Público-Privadas (PPP), um valor que representa 46,4% do financiamento global deste conjunto de projectos. Entre este ano e 2014, a banca portuguesa vai ter que assegurar quase metade daquela verba, cerca de 1,36 mil milhões de euros, para que tudo decorra como acordado. Isto numa altura em que os empresários das empresas exportadoras e das PME reclamam mais crédito por parte da banca e tanto o PSD, CDS como o BE estão contra este investimento dada a situação do país.
O restante investimento está assegurado pela banca internacional, que ficou com uma fatia de 28,1% (1,63 mil milhões de euros) e pelo Banco Europeu de Investimento com 25,4% (1,48 milhões de euros).

No dia 13 de abril de 2011, foi lançado oficialmente o Edital de Convocação para Projetos Franco-Brasileiros de Cooperação Descentralizada Trilateral em Benefício do Haiti e dos países do Continente Africano.

Trata-se de iniciativa que privilegia o apoio a projetos de cooperação internacional, a partir da experiência dos governos subnacionais brasileiros e franceses em favor de um terceiro país nas áreas de governança local, agricultura e segurança alimentar, saneamento e recursos hídricos, formação profissional, mobilidade urbana, saúde, desenvolvimento sustentável e meio ambiente, infra-estrutura e urbanização.

Os governos locais, estaduais e regionais brasileiros, em cooperação com coletividades francesas poderão apresentar propostas de projetos de 15 de maio a outubro de 2011.

BEI com ratings mínimos para garantes

O Banco Europeu de Investimento sempre definiu ratings mínimos para os bancos que emitiam garantias de pagamento a favor do BEI por conta dos concessionários de contratos de PPP.   A maioria dos concessionários são financiados a 15-20 anos pelo BEI,  que geralmente assume pouco ou nenhum risco de crédito dos concessionários.  Nestes casos, são os bancos comerciais, ou a seguradoras de crédito, que retêm o risco de crédito e emitem garantias a favor do BEI.   

Agora que os credit ratings de bancos portugueses foram cortados drasticamente, alguns dos bancos portugueses já não cumprem os requisitos mínimos e portanto já não servem para garantes.  Para remediar a situação, o BEI vai exigir que os bancos entreguem outros valores em caução (collateral) parcial, em função do risco do mutuário garantido.  

Esta necessidade de "desembolsar" o valor das garantias das PPP vem agravar ainda mais os actuais problemas de funding e liquidez.  

Eis mais uma questão critica para a qual será necessário negociar alívio junto dos credores externos e do  FMI.  Seria importante que o BEI, ou o FEI,  libertasse as garantias dos bancos comerciais.  O BEI pode bem passar a assumir directamente o risco de crédito dos concessionários de PPP, que tem toda a capacidade para avaliar, deixando de sobrecarregar a banca comercial.

Portugal tem eleições nacionais quase todos os anos, o que torna o país quase ingovernável, um sindroma bem conhecido dos cientistas políticos.
Aos gravosos défices comerciais e orçamentais, acrescenta-se o défice de liderança e governação.

Em tempo de eleições, não se dão más notícias nem se aplicam medidas de austeridade, especialmente num sistema de "winner takes all" em que o perdedor tem tanto a perder.  Em vez de coligaões pre-eleitorais, parece haver sim um conluio tácito entre as  candidaturas de manter as ilusões dos eleitores com promessas mais ou menos insustentáveis.

E parece que os eleitores nem sequer desconfiam de tamanha esmola.

A despesa pública e a dívida pública crescem sempre mais em anos de eleições, do que nos outros anos. Também fora da Administração Pública, as empresas públicas contratam mais em época de eleições, segundo um estudo indicado abaixo.  Isto é, ao custo directo da realização de eleições, devemos acrescentar os "custos de oportunidade" da agitação e ilusão eleitoral.

Ainda está por demonstrar se as "eleições em tempo de crise de 2011"  serão mais austeras, ou se se repitirá a habitual  "coligação tácita para a ilusão".

Investigador português em Londres estudou contratações nas empresas públicas relacionadas com eleições.

Um economista investigador português na Universidade Queen Mary de Londres, Pedro S. Martins, terminou em Novembro um estudo onde concluiu que as contratações das empresas públicas em Portugal "aumentam significativamente nos meses imediatamente antes e imediatamente depois das eleições legislativas".

Intitulado, em inglês, cronyism - expressão que pode ser traduzida por "nepotismo", "compadrio" ou "favorecimento de amigos" -, o estudo foi feito para o IZA, Instituto de Estudos do Trabalho, em Bona, Alemanha.

O investigador afirma, nas conclusões, que embora haja muita produção "anedótica" sobre "o compadrio nas nomeações para os sectores públicos", este é "o primeiro estudo que fornece evidência empírica sistemática sobre esse fenómeno". Baseou-se nos "Quadros de Pessoal" do Ministério do Trabalho, "um census anual particularmente rico de todas as empresas que operam em Portugal e que empregam pelo menos um trabalhador".

 Pedro S. Martins estudou o período de 1980 a 2008, estabelecendo firmas do sector privado como grupo de controlo comparativo, e concluiu: "As nomeações do sector público aumentam significativamente ao longo dos meses imediatamente antes de um novo governo tomar posse. Também aumentam consideravelmente logo após as eleições, mas somente se o novo governo é de uma cor política diferente da do seu antecessor."

We are looking for a “Corporate Management Specialist” for an ongoing project in Timor Leste that focuses on developing standard processes and policies for the project implementation in the Ministry of Infrastructure, focusing on electricity and water sanitation.     Result One Team Leader - Saúde para Angola

     MSH is seeking candidates for an upcoming, results-oriented, five-year program in Angola that will improve the health of Angolans by increasing the availability and use of high quality services in key areas including family planning, malaria, and HIV & AIDS.     OVERALL RESPONSIBILITIES:
    The Result One Technical Lead will sit at the central level in Luanda and will be responsible for leading and managing all Result One leadership, management, human resource, and health information system (HIS) strengthening activities at the municipal and provincial levels in Luanda and Huambo Provinces, as well as providing HIS technical support at the central level.
    The ideal candidate will have prior experience working in Angola, in coordinating complex, preferably USAID-funded, projects, and state-of-the-art expertise in international standards. Has a proven track record in leadership, management, organizational development, human resources for health management capacity and systems, and health information management systems. PPP Best Practices in Latin America, 4-May, Washington, DC

The World Bank is pleased to invite the members of the Global PPP Network to attend a conference:
PPP Financing Public-Private Partnerships – Best Practices in Latin America
May 4th – 5th, 2011
World Bank Headquarters, Washington, DC.

The conference is open to officials involved in PPPs from the public sector, private sector and academia.  It will be held in English and Spanish, and registration is free, pending acceptance.

O 12.º Fórum Anual da Sociedade Luso-Americana de Pós-Graduados, vai ter lugar dias 16 e 17 deste mês, no Schwartz Lecture Hall do Langone Medical Center, pertencente à New York University – em Manhattan. A entidade, sem fins lucrativos e apolítica, é conhecida também pela sua sigla em inglês, PAPS (Portuguese-American Post-graduate Society).
O actual presidente da PAPS, Rogério Candeias, frequenta a Universidade de Harvard e o Instituto de Tecnologia de Massachusetts (M.I.T.), onde completa o seu doutoramento em Biologia.
Criada para “estimular o desenvolvimento de relações sólidas entre os estudantes pós-graduados a viver nos Estados Unidos e a sociedade americana em geral”, a PAPS tem igualmente como objectivo promover uma imagem positiva de Portugal – pode-ser ler nos seus estatutos.
No dia 16 de Abril, sábado, o Fórum propõe uma série de debates com painéis e a abordagem de temáticas como ‘A Ciência em Portugal: O Caminho para o Futuro’, ‘O Impacto da Diáspora na Economia Portuguesa’ e ‘Portugal: A Marca’.
Abrirá o Fórum, com uma intervenção às 9:00 da manhã, o presidente da PAPS, Rogério Candeias, falando seguidamente Nuno Brito, embaixador de Portugal nos EUA. Os participantes ao evento poderão depois ouvir a dissertação a fazer por José Mariano Gago, ministro da Ciência, Tecnologia e Ensino Superior de Portugal.
O debate da tarde, subordinado à temática ‘O Impacto da Diáspora na Economia Portuguesa’, será moderado pelo jornalista Mário Crespo, da SIC, e contará com a participação de António Simões (HSBC), António Câmara (YDreams), José Graça Medeiros (MCG), Gabriel Alonso (EDP Renewables Group) e Ricardo Marvão (‘The Beta-i Association).
O dia de sábado encerra com a realização de um jantar na NYU Langone Medical Center Faculty House, onde será divulgado e apresentado o ‘Prémio de Liderança 2011’ da PAPS. O contemplado poderá optar pela soma em dinheiro de 3.500 dólares ou estágio de duas semanas no Plug and Play Tech Center.
O domingo está reservado à realização da Assembleia Geral da PAPS, onde serão eleitos os novos corpos gerentes da Sociedade.
O NYU Langone Medical Center está localizado no número 550 da Fifth Avenue, em Nova Iorque.
